Judge vacates citation for unprotected machinery

Companies can’t be cited for exposing workers to dangerous moving machine parts if employees are unlikely to be near the machinery, a federal administrative law judge ruled in a Nov. 21 final order.
According toBloomberg Environment, the judge, Patrick Augustine from the Occupational Safety and Health Review Commission, vacated a serious violation and $4,712 fine issued by the Occupational Safety and Health Administration in April 2018.
OSHA alleged that the grain processing company Gavilon Grain LLC’s corn mill in Burley, ID, had violated the agency’s machine guarding rule requiring workers to be protected from moving machine components.
